Irish Lawsuits Work to Dismantle Ban on CBD Oil in Ireland

Navan, Meath, 21st Jan 2022, ZEXPRWIRE, The Irish High Court has recently been hearing a considerable number of lawsuits in order to better understand the use of CBD in Ireland. The result has been a hearing date scheduled for the middle of July 2022.  

The fact there is going to be a hearing is a positive sign and one that should hopefully end this nightmare for many CBD businesses, some of whom have been raided and have product destroyed, according to Cormac Reynolds of CBDOilIreland.ie

At the moment, all THC products have been categorically banned by the Irish State without any risk assessment completed on the products. This is in line with the 1977 act prohibiting any and all products that contain THC, the psychoactive chemical found in Cannabis. But EU law takes precedence over the 1977 Act and states that products that contain less than 0.2% THC are permitted.  

In the past few months, there have been many police raids conducted on several businesses and many products have been seized and destroyed. This has caused many people to request clarification on the Irish ban on THC products and how they conflict with EU regulations.  

Additionally, “a coherent regulatory framework” has been requested by the Hemp Federation of Ireland that will “allow the function of indigenous industry”.

The Irish Government has tried to circumvent the KanaVape ruling. The European Commission along with the World Health Organization and the ECJ have all acknowledged the safety of CBD products and the effort to scientifically prove that CBD is unsafe will be a daunting task. The only machination the Irish State has to clobber the CBD industry is the 1977 Act, which predates the discovery of CBD as a non-psychoactive cannabinoid and mistakenly assumes that all cannabis products contain THC and are therefore illegal.
